These Terms govern the relationship between St. Mary Public School, its students, parents, guardians, and visitors. Please read them carefully.
These Terms of Service are prepared in compliance with the Right to Education Act (RTE), 2009, the National Education Policy (NEP) 2020, the Uttarakhand Education Act, guidelines of the Uttarakhand Board of Secondary Education, and applicable provisions of Indian Contract Law. By enrolling a child at St. Mary Public School, or by using this website, parents/guardians agree to these Terms.
Terms & Conditions
Transparent guidelines that govern our relationship with students, parents, and the wider school community.
1. Definitions
- "School" refers to St. Mary Public School, Phool Chaur, Nainital, Uttarakhand 263139.
- "Student" refers to any child enrolled at the School.
- "Parent/Guardian" refers to the parent or legal guardian responsible for the Student.
- "Services" refers to all educational, co-curricular, and administrative services provided by the School.
2. Admission Policy
Admission to St. Mary Public School shall be open to all children without discrimination on the grounds of religion, caste, race, gender, language, disability, or economic status, in accordance with the Right to Education Act, 2009 (Section 13).
- Children aged 3 to 14 years are eligible for admission across Play Group to Grade 8
- 25% of seats in entry-level classes are reserved for Economically Weaker Sections (EWS) and Disadvantaged Groups under Section 12(1)(c) of the RTE Act
- The School does not conduct any capitation fee, screening, or interview for admission — in strict compliance with Section 13 of the RTE Act, 2009
- Admission is subject to submission of required documents including birth certificate, Aadhaar card (optional but encouraged), caste certificate (if applicable), and transfer certificate (for migration cases)
- The School reserves the right to refuse admission only on grounds strictly permitted under law (e.g., age ineligibility or full capacity)
3. Fee Policy
- Fee structures are reviewed annually by the School Management Committee (SMC) and displayed on the school notice board
- Fees once paid are non-refundable except in cases of School-initiated cancellation of admission
- The School does not collect capitation fees of any kind — which is prohibited under Section 13(1)(a) of the RTE Act, 2009
- Students admitted under RTE / EWS provisions are entitled to free education as per the applicable government reimbursement scheme
- Late fee charges, if any, shall not exceed the amount specified in the School's published fee schedule
- Parents experiencing financial hardship may approach the Principal's office to apply for fee deferment or waiver under the School's internal scholarship programme
4. Code of Conduct — Students
All students are expected to conduct themselves with dignity, respect, and responsibility. The following behaviour standards apply:
- Regular and punctual attendance is mandatory. Chronic absenteeism may lead to removal from rolls after due parental notice
- Students must wear the prescribed school uniform during school hours and on school premises
- Respect for all teachers, staff, fellow students, and school property is mandatory
- Any form of bullying, physical or verbal abuse, ragging, harassment, or discrimination shall be treated as a serious misconduct subject to disciplinary action
- Use of mobile phones by students during school hours is strictly prohibited
- Vandalism or wilful damage to school property shall require compensation from the parent/guardian
5. Code of Conduct — Parents & Guardians
- Parents are expected to interact with school staff in a respectful and professional manner at all times
- Aggressive, abusive, or threatening behaviour towards teachers or staff on school premises is a criminal offence and will be treated accordingly
- Parents must attend Parent-Teacher Meetings (PTMs) when convened by the School
- Parents must ensure their ward attends school regularly and completes assigned homework and revision
- Any grievance regarding school operations must first be directed to the class teacher, then to the Principal, and if unresolved, to the School Management Committee (SMC)
6. Anti-Ragging & Bullying Policy
🚫 Zero Tolerance Policy — Strictly Enforced
St. Mary Public School maintains a Zero Tolerance Policy against all forms of ragging, bullying, harassment, and violence on school premises or during school-sponsored events. This policy is aligned with the UGC Regulations on Curbing the Menace of Ragging (adapted for the school level) and the POCSO Act, 2012.
- All complaints of bullying or harassment will be investigated by the school's Grievance Committee within 7 working days
- Disciplinary action may include written warning, suspension, or expulsion depending on severity
- Cases involving physical assault or sexual misconduct will be reported to law enforcement authorities
7. Special Educational Needs
In compliance with the Rights of Persons with Disabilities Act, 2016 and the RTE Act, 2009, the School is committed to providing reasonable accommodations to students with disabilities. Parents are requested to disclose any special educational needs at the time of admission so appropriate support may be arranged.
8. Photographs, Videos & Media
- The School may photograph or video-record students during school events for official school communications, including the school website and Facebook page
- Parents who wish to opt out must submit a written request to the school office
- Parents and visitors must seek prior permission before photographing other students on school premises
9. Withdrawal / Transfer
- Parents must submit a written withdrawal request at least 30 days in advance to allow processing of transfer certificates
- All outstanding dues must be cleared before a Transfer Certificate is issued
- Transfer certificates are issued free of charge, in compliance with RTE Act provisions

✅ Complaints are acknowledged within 48 hours and resolved within 15 working days.
Unresolved complaints may also be escalated to the Block Education Officer (BEO), Nainital or the District Education Officer (DEO), Nainital, as appropriate.
13. Amendments to These Terms
The School reserves the right to update these Terms at any time. Material changes will be communicated via school circular, the notice board, and this website at least 15 days before taking effect. Continued enrollment constitutes acceptance of the revised Terms.
